NFTs often include representations of artwork or design, or other creations that were previously created and captured in a different form or medium. This can lead to difficulties regarding exploitation rights, where the owner of a TVN is not necessarily the owner of the intellectual property rights in the underlying creation or may not even have a license at all in relation to it. these underlying rights.

What is an NFT?

Unlike fungible (i.e. indistinguishable and interchangeable) digital assets such as bitcoin or other crypto currencies, non-fungible tokens are unique assets that cannot simply be exchanged for an identical replacement. Their authenticity is certified through “distributed ledger technology” such as blockchain. As unique digital assets, they can be very valuable and highly sought after, potentially generating additional payments to the original token creator each time the token is sold, on top of the original purchase price.

Intellectual property rights and NFT

The protection of intellectual property rights relating to DTVs is an interesting area. Just because a TVN is created and represents an underlying work of art or other creation, does not mean that the creator or any subsequent owner of the TVN will own the underlying intellectual property rights, for example the right to ‘author.

An owner of TVN should be aware that he should expressly acquire an assignment or license of the underlying rights from the creator or author of the original work or any subsequent owner of such rights, in order to be able to reproduce the underlying work itself. The owner of the underlying intellectual property rights may choose to grant a license but impose other constraints on how the work in question may be used in the NFT.

An example often used is that of the NFT for a video of a slam-dunk by famous American basketball player LeBron James, released as part of a limited edition digital trading card series of NBA clips that can be purchased. and sold on the “Top Shot” market. The dunk card may sell for a large sum of money, but the NBA still owns the copyright to the original video, and any reproduction of that video is still subject to the NBA’s licensing terms.

If you are lucky and wealthy enough to acquire one of the few NBA NFTs, you are still not allowed to edit the video moment captured in your NFT, or sell any merchandise related to your NFT, without the prior consent of the NFT. As the owner of the copyright in the original source code, Sir Tim has no license restrictions and has the right to reproduce the code during the creation of the NFT.

Software protection

The software itself can be protected in several ways. Protection can be sought through patents if the invention is captured as a technical system implemented using particular software, rather than the software itself. Before coming to HBS, I viewed entrepreneurship as a solo business – something you only undertake if you have a worthy idea, unwavering self-confidence, and a closet full of black turtlenecks. Back in my days in consulting and then in a growing startup, I had come to see myself as the ultimate team player and not at all the type of person who would go it alone. I like to immerse myself in new situations and diverse teams to solve new problems and this interest in team dynamics, problem solving and rapid change made me think that the entrepreneurial path is not for me.

Slowly but surely at HBS I started to get the entrepreneurship bug. I would sit in class thinking about the decisions I would make in the protagonist’s position and realize with total shock that… I would like to be in that person’s shoes. Since when did I become that person who wanted to make tough decisions rather than the repairman who put out fires and shake things up after those decisions were made?

This slow and constant slide towards testing my own idea has been greatly accelerated by the pandemic. The timing for this insane combination of wanting to connect with friends and family, wanting to spread a little joy wherever possible, and feeling ready to test out some great epiphanies that I had in semester of autumn. In the HBS Authentic Leadership Development (ALD) course, I had two major achievements that really changed the course of my career and honestly, I think about my life in general.

  • First, my job will not be the thing that fulfills me in all aspects of my life. I want to have a balance between my work, my friends, my family and my hobbies. This is what started to spin my brain on the idea of ​​a “side crush”.
  • Second, I have to look for things that I’m not only good at, but that I enjoy doing.

After a year and a half of HBS cases, eight months of a terrifying pandemic, and a lot of soul searching, it suddenly felt like the next step was totally obvious (but I think the idea had been germinating for a VERY long time). I was going to start my own business and I was going to sell my favorite thing to do: greeting cards.

Rebound! I saved most of the greeting cards I received and have always enjoyed making cards for friends and loved ones for birthdays and special occasions. But… now I was really going to put them on the Internet? For the world to see?!?!? This is where my team came in. I had thought entrepreneurship was a lonely business, but in fact it only solidified who my real team is. I had to reach out to trusted friends and advisers for ideas, feedback, and advice. I had to open up in a whole new way for me and share a side of myself that I hadn’t really shown before. I had to ask for help – something that I have historically avoided at all costs.

However, instead of feeling like a burden on these friends and family members, I feel like I have strengthened these relationships. To ask someone to trust you, you also have to be vulnerable with them, and there aren’t many ways to be more vulnerable than putting your glittery doodles on the World Wide Web for sale. So I created a Shopify account, created a “punny” name for my new store, and ordered a printer and cardstock. This is how Maker Scholar was born! Now I sell greeting cards, personalized artwork and a lot of other things that I make with my hands and art supplies through Shopify and Instagram from my little home ‘studio’ (i.e. my kitchen table).

It’s amazing how something that started out as a way to connect people while on vacation has turned into a passion and I’m so grateful to the professors and classmates at HBS who have helped me make it happen. get there. There is nothing I love more than receiving a text from a friend who sent my cards to a loved one, telling me how happy it made them. I have a saved photo of a friend whose grandfather has my cards displayed proudly in his house and shows it whenever she comes. It’s so special that I can make these ties with a piece of card stock that I loved making.

HBS courses like ALD, Managing Service Operations, How to Talk Gooder and eCommerce have given me essential skills to be able to start and run this small business, and I am very grateful to the professors themselves to be the people they are in. are and out of class. When I mentioned (nervously) that I had started an online greeting card business (who buys greeting cards online?!?!), I would be terrified to see an expression on their faces that said, “Oh. .. I see “. But it was always the opposite. They took the plunge and showed a level of excitement and commitment that really pushed me to keep going. Again, this was just another lesson in how entrepreneurship really is a team sport.

My time at HBS changed my way of thinking about the world and myself. During my freshman year I started to realize that a lot of the things I love the most about my job so far – being a generalist, meeting a lot of new people, asking tough questions, getting dirty. hands on a truly granular project – were all elements of entrepreneurship. The problem was, I had gotten used to a specific entrepreneur archetype and that archetype was nothing like me. I didn’t want to build the next big international organization and I still don’t want to. But as my world grew with every protagonist I met, every classmate I got to know, and every new skill I learned, I started to think that maybe there was actually a version of entrepreneurship for me. This version feels like a sideways scramble that fills my cup, strengthens and expands my connections in life, and asks me to explore a part of myself that I’ve left mostly hidden until now. I can’t wait to see where this prospect takes me and my small business.

I first discovered the MRSC in the spring of 1978, when I was completing my BA in Political Science at the University of Washington (UW). One of my professors sent me and a few classmates to meet John Lamb, who was then Managing Director of MRSC, and interview him for a research project we were working on. We were trying to assess the impacts of I-276, the state’s public disclosure law, on people’s willingness to show up at local offices. John was very helpful and was a great help in our research. As it turned out, this wasn’t a small hurdle, especially personal income tax reporting requirements, for many local officials we interviewed.

Later that summer, after I graduated, I called John and volunteered to work for the MRSC as a summer intern. To my surprise and pleasure, he agreed not only to hire me, but also to pay me! My first desk was in the janitor’s closet, complete with a utility sink, IBM Selectric typewriter, and a ladder to the roof of the building, and I couldn’t have been happier. It was the unlikely start of what has become a 43-year career as a public policy and management consultant for the MRSC. I only realized in hindsight that such openings don’t happen very often, and I had just introduced myself when this one did. Looking back, I’ve always wondered if it was divine providence or just luck, though now I’m inclined to believe it was more the first.

When I started working at the MRSC in July 1978, we shared a small two-story building with the Association of Washington Cities (AWC), right next to the UW campus. I still remember my first day, when I was introduced to Kent Swisher, Executive Director of AWC, and Stan Finkelstein, Deputy Director. Peter King also worked in this former U District office for a while, and I was very happy to see him take on the role of Executive Director of AWC in 2015.

I spent my first four years at the MRSC as a Research Assistant working under the supervision of Dr Ernest Campbell, Municipal Law Specialist at the MRSC, and pursuing my Masters of Public Administration (MPA) at the Graduate School of Public Affairs (GSPA) of UW, now Evan’s school. I was never completely sure that “Dr. C”, as we used to call him, knew that I was working on my MPA and not on my JD, because he started to give me a fairly good training in the field of. municipal law, which has served me well all these years. To date, the Washington State Association of Municipal Lawyers on his behalf presents an annual Lifetime Achievement Award for excellence in the practice of municipal law. It was a great privilege for me to have been able to work with Dr C.

It took me four years to complete the two-year GSPA program, working part-time at the MRSC, but when I graduated John Lamb offered me a full-time position as a first MRSC public policy consultant. The years that followed were a fascinating and exciting time to work at MRSC, as they encompassed the introduction of computers to the workplace and the equally incredible Internet that promised to connect everyone to a “global web”. . Of course, all of these technological developments were perfect for the main mission of the MRSC, which has always been to provide accurate information and advice to local governments in Washington as quickly and efficiently as possible.

So we got to work on creating our first website with local and national news, a searchable document database, a full set of topic pages, and later blogs, training events, and more. I also had the opportunity to participate in the development of our first electronic newsletters which allowed us to distribute much of the information on our website to a subscriber base that now has nearly 30,000 subscribers. In my own community of Kirkland, I had the honor of serving on the city’s planning commission for eight years and learning first-hand from the hard work and dedication of local elected officials and officials and staff. .

I feel so blessed and privileged to have had the opportunity to spend my career at the MRSC serving towns and villages, then county governments, and now many special districts as well. I could not have had this opportunity elsewhere. In fact, this statement is literally true since the MRSC is almost entirely unique to the country. The only other organization that comes close to the MRSC model is the Municipal Technical Advisory Service (MTAS) in Tennessee.

One of my only regrets in all these years that I have been in the MRSC is the fact that there is still, except MTAS in Tennessee, no other state that has an organization serving its people. local governments quite like the MRSC. I firmly believe that the local governments of each state would benefit greatly from the support of an organization similar to the MRSC. Whenever I have had the opportunity to participate in national conferences or other contacts with representatives from out of state, I have always encouraged them to take a look at the MRSC model and consider defend the concept in their state.

Believe it or not, the MRSC will be celebrating its 100th anniversary in just fifteen years. I think it would be a laudable tribute if, by the time we reach this incredible milestone, we can also celebrate the successful transfer of the MRSC model to at least two or three other states. That might be enough to trigger its adoption in many other states.

As I set off on new adventures, I would like to leave you, lovers of local government, a challenge and a request: to seize all the opportunities that will arise in the future to publicize the good work that the MRSC is doing to to local communities in Washington, to your colleagues in other states, and to encourage them to become a champion of the concept in their state.
